The client is responsible for the condition and safekeeping of the rental equipment and may be liable for any equipment which is lost, stolen or damaged during the rental period. Damage Waiver is provided at no extra cost to reduce a client’s financial liability during their rental of Coastal Tool Hire equipment.
Financial liability refers to loss or damage related charges which could equal up to the new replacement value of the rental equipment, salvage costs & rental charges incurred during repair/replacement if the equipment is lost, stolen or damaged.
Some examples of when Damage Waiver Protection is required.
- If you have not budgeted for unexpected damage to the rental equipment.
- If you do not have appropriate insurance with Coastal Tool Hire noted as an interested party.
- If your insurance policy does not cover rental equipment.
Unless you are advised otherwise in writing by Coastal Tool Hire, damage waiver is compulsory when establishing an account with Coastal Tool Hire and automatically applied to all rentals at no extra charge.
What does Damage Waiver cover? *
Loss or damage to rental equipment caused by collision, fire, storm, accident, earthquake or theft.
12. DAMAGE WAIVER
12.1 Damage Waiver is not insurance but is an agreement by CTH that the Customer’s liability for damage to the Equipment can be limited in some circumstances only, to an amount called the Damage Waiver Excess.
12.2 Damage Waiver applies to all hires, subject to the conditions below, for no additional fee. The Damage Waiver Excess is the actual recovery and repair cost of the Equipment, $1,500 or 20% of the current replacement cost of the Equipment as reasonably determined by CTH using suppliers list prices, whichever is the lesser amount.
12.3 The Damage Waiver, subject to the clause the Hirer’s liability for the loss or damage to Tool Equipment caused by fire, storm, earthquake, collision, accident or theft is limited to $1,500 or 20% of the full new replacement as reasonably determined by CTH using suppliers list prices, cost of the Tool Equipment whichever is the greater. This applies per single incident.
12.4 Loss or damage to the Equipment during Loading/Unloading and during transport is not covered by the damage waiver.
12.5 The Damage Waiver does not apply to loss or damage if in the reasonable opinion of CTH, the loss or damage to the Tool Equipment has arisen from anything referred to in clause 11.
Some liability not covered by Damage Waiver *
Damage resulting from misuse or abuse of the equipment, negligent acts or omissions of the client, failing to maintain the equipment or improper servicing or during transport including loading / unloading.
Loss or damage resulting from a breach of any of the terms of the rental agreement including failing to protect the equipment from theft, loss or damage.
